Generally, after all documents have been disclosed and before the full hearing, both parties will be required to prepare and exchange witness statements. (This is the case in England and Wales; Scottish Tribunals do not require witness statements to be prepared, although the parties may wish to prepare statements to assist the witnesses`preparation for the hearing, and to evaluate the evidence).
Witness statements should not be disclosed to the other side in advance, as this will allow it the benefit of seeing what your witnesses are going to say when preparing its witnesses` evidence.
