NOTE: If there are already elected trade union representatives in the organisation, representing affected employees, they must be included in the consultation process.
If there is an existing consultation body (e.g. a Staff Council) they can potentially be the representatives for the collective consultation. However, they must have been elected to represent the affected employees for the purpose of collective redundancy consultation.
How do you arrange for representatives to be elected?
Elected representatives must be employed by the employer at the time of their election or appointment.
