TUPE - 2014 changes

1.                 Introduction

Changes to the 2006 TUPE Regulations apply to all TUPE transfers occurring on 31 January 2014 onwards with the exception of the change to Employee Liability Information which will only apply to transfers from 1 May 2014 and the change relating to micro-businesses which will only apply to transfers from 31July 2014.

 

2.                Service Provision Changes

The definition of a service provision change has been tweaked to bring it in line with the case law position that the relevant activities must remain fundamentally the same following transfer.  This will not have any practical impact as this was the case law position in any event.   Whilst case law previously required activities to be ‘fundamentally and essentially’ the same the omission of the words ‘and essentially’ are not thought to have any significance.
