GDPR Factsheet

The EU General Data Protection Regulation (“GDPR”) comes into force on 25 May 2018 across the EU (including the UK) and represents a significant overhaul of data protection laws. Below are outlined the key changes you need to consider to be compliant with the GDPR.

The GDPR will apply to all businesses:

  • processing data in the context of the activities of an establishment of a controller or processor in the EU (whether the processing takes place in the EU or not);
  • processing personal data of EU data subjects (regardless of whether the controller or processor is established in the EU) where the activities relate to:
    • offering goods or services to data subjects in the EU, irrespective of whether a payment of the data subject is required; or
    • the monitoring of data subjects’ behaviour in the EU. Non-EU resident business processing data on EU citizens must appoint a representative within a relevant member state.
