Legal Framework

All employees have the statutory right to claim unfair dismissal. From the 6th Aril 2012 the minimum qualifying period of service needed to bring an unfair dismissal claim increased from one to two years for all new entrants. Employees who started employment prior to this date are eligible to bring an unfair dismissal claim if they are dismissed after completing one year’s service. In addition, in certain circumstances, no qualifying period of service is necessary, for example, where the dismissal relates to:

  • Pregnancy
  • Health and safety
  • Union activities
  • Assertion of a statutory right
  • Whistleblowing

 It would therefore be wise to follow the procedures described below on every occasion.
